TERMS AND CONDITIONS FOR SERVICES PROVIDED


Disclosure: These terms and conditions have been authorised for use by Logic Electrical Pty Ltd


  1. These Terms and Conditions (“Terms”) apply to all quotations (“Quote”) issued by Logic Electrical Pty Ltd (ACN 162 228 159) (“we”, “us”, “our”) to the customer (“you”, “your”).
  2. Definition


In these Terms:

  • Access means safe, reasonable, and uninterrupted physical access to the work site, including power supply and necessary facilities.
  • Australian Standards means all applicable Australian standards, including AS/NZS 3000 (Wiring Rules).
  • Goods means all materials, products, parts, or equipment supplied by us in connection with the works.
  • High Voltage Work means any electrical work on systems operating above 1,000 volts AC or 1,500 volts DC.
  • Quote means the written document provided by us to you outlining the scope of works, estimated price, and any other relevant details.
  • Scope of Work means the specific tasks, works, and deliverables described in the Quote.
  • Services means the electrical works and related activities we are engaged to perform under the Quote.
  • Site means the location where the Services are to be performed.
  • Variation means any change to the Scope of Work after the Quote is accepted.


3. Scope of Work

  1. The scope of work is as set out in the Quote and is based on the information provided by you at the time of preparing the Quote.
  2. Any variations, omissions, or additions to the scope will be charged as a variation in accordance with clause 6.


4. Acceptance of Quote

  1. By signing, emailing acceptance, or otherwise authorising us to proceed, you agree to these Terms.
  2. Quotes are valid for [30] days from the date of issue, unless otherwise stated.


5. Price and GST

  1. All prices are in Australian dollars and exclusive of GST unless otherwise stated
  2. GST will be charged in addition to the quoted amount in accordance with applicable law.


6. Variations

  1. Any variation to the scope of work must be agreed in writing before the work is undertaken.
  2. Variations will be charged at our standard hourly rates plus the cost of materials, unless otherwise agreed.


7. Access and Site Conditions 

  1. You must ensure we have safe, reasonable, and uninterrupted access to the site during agreed working hours.
  2. If we are delayed due to restricted access, unsafe site conditions, or other factors outside our control, additional charges may apply.


8. Exclusions

  1. Unless expressly included in the Quote, the following are excluded from the price:
  2. Rectification of pre-existing faults;
  3. Work involving asbestos or hazardous materials;
  4. Civil, structural, or non-electrical works;
  5. Authority application fees or inspection costs;
  6. Any work involving High Voltage Work, including installation, maintenance, or repair of high voltage equipment. 


9. Subcontractors

We may engage suitably qualified and licensed subcontractors to perform all or part of the works, provided we remain responsible for the delivery and quality of the services under these Terms.


10. Warranties and Compliance

  1. All work will be carried out in accordance with relevant Australian Standards.
  2. We warrant our workmanship for [12] months from the date of completion. Manufacturer warranties apply to supplied products.


11. Dispute Resolution

  1. If a dispute arises, both parties must first attempt to resolve it in good faith through direct negotiation
  2. If the dispute cannot be resolved within 14 days, either party may refer the matter to mediation through the Resolution Institute of Australia before commencing legal proceedings, except for urgent interlocutory relief.


12. Limitation of Liability

To the maximum extent permitted by law, our liability for any breach of these Terms or statutory warranty is limited to:

  1. re-supplying the services; or
  2. the cost of re-supplying the services.



13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts in respect of any proceedings in connection with these Terms.
